These terms apply to this website and to the Kelly Stake service at app.kellystake.com. Kelly Stake (“we”, “us”) is based in the United Kingdom. By using either, you agree to these terms. Please also read our Privacy policy and Risk disclosure.
1. What Kelly Stake is
Kelly Stake is software for sports trading strategies that you supply. It lets you backtest a strategy on historical data, run it in paper mode against live markets, and — only when you switch it on — place orders on your own Betfair Exchange account, under your authority and within limits you set.
We are a software provider. We are not:
- a bookmaker, betting exchange or gambling operator — we do not accept bets or take the other side of any bet;
- a holder of client money — your funds stay in your own Betfair account, and we never hold, move or have custody of them;
- a tipster or adviser — we do not offer tips, predictions or recommendations;
- authorised or regulated by the Financial Conduct Authority.
Kelly Stake is independent and is not affiliated with, or endorsed by, Betfair.
2. Early access
Kelly Stake is not yet generally available. Joining the waitlist does not guarantee you an account or a date for one, and the features described on this website may change before or after launch.
3. Who can use Kelly Stake
To use Kelly Stake you must:
- be 18 or over;
- live somewhere that using a betting exchange is lawful for you;
- for live trading, hold your own verified Betfair account and comply with Betfair’s terms.
You must not use Kelly Stake if you have self-excluded from gambling, including through Betfair or GAMSTOP.
4. Your responsibilities
You decide which strategies run, what limits apply, and whether trading is live. You are responsible for every order placed on your Betfair account — whether you placed it or a strategy you enabled did. Keep your Kelly Stake login and any Betfair credentials or keys secure, and tell us straight away at contact@kellystake.com if you think someone else has access.
Do not use Kelly Stake unlawfully, to break Betfair’s terms, or in any way that could damage the service or other people’s use of it — including by trying to access it by automated means we have not provided, or to probe, scrape or overload it.
5. No advice and no guarantee
Nothing in Kelly Stake or on this website — including backtests, paper-mode results, example figures or product illustrations — is financial, betting or investment advice, or a promise of profit. Past performance, simulated or real, is not a reliable indicator of future results. Betting carries a risk of loss; see the Risk disclosure.
6. Fees
Kelly Stake does not currently charge for access. If we introduce fees, we will show you the price and the terms before you are asked to pay, and you will not be charged without agreeing to them. Commission and any other charges Betfair applies are set by Betfair, are paid to Betfair, and are separate from anything we charge.
7. Availability
We work to keep Kelly Stake running, but we cannot promise it will always be available or free of errors. Maintenance, Betfair API outages, data delays or connectivity problems can stop strategies from evaluating markets or placing orders. The service is designed to halt new trading rather than act on stale or incomplete data, but it cannot guarantee that you will be able to open, change or close a position at any given moment.
8. Our responsibility to you
If we fail to comply with these terms, or fail to provide the service with reasonable care and skill, we are responsible for loss you suffer that is a foreseeable result of that failure.
We are not responsible for:
- losses from betting — including the outcome of events, market movements, and the strategies, stakes and limits you choose;
- anything Betfair does or does not do, including outages, rejected or unmatched orders, account restrictions and charges;
- losses caused by events outside our reasonable control;
- business losses, if you use Kelly Stake for business purposes.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded by law. If you are a consumer, nothing here affects your statutory rights, including under the Consumer Rights Act 2015.
9. Our content
Kelly Stake, this website, and their software, design and content belong to us or our licensors. You may use them to use the service as intended; you may not copy, resell or reverse-engineer them except where the law allows. Your strategies and your data remain yours.
10. Suspending or closing accounts
You can stop using Kelly Stake and ask us to close your account at any time. We may suspend or close an account if we reasonably believe it breaks these terms, is being used for fraud or unlawfully, belongs to someone under 18 or who has self-excluded, or puts the service or other users at risk. Where we can, we will tell you why first.
11. Changes to these terms
We may update these terms as Kelly Stake develops. We will change the date at the top of this page, and if a change materially affects you we will tell you before it takes effect. If you do not accept a change, you can stop using the service.
12. Law and disputes
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts, and the mandatory consumer protections of where you live continue to apply.
